In a unanimous decision, the Tennessee Supreme Court reinstated a jury verdict against an assisted living facility, finding that there was material evidence to support the jury’s determination that understaffing at the facility caused the death of a resident.
Significantly, the Court relied on testimony that the management company operating the facility was made aware of the understaffing problem, but failed to take appropriate steps to ensure the safety of its residents.
